Abstract

In 2001 National Institute of Criminology has made impact study on changes that came into force on 1st of March in 1999 concerning legal phrase of drug abuse in Penal Code. Results point out that effectiveness of modification (Act LXXXVII. 1998 ) is queried. In case we suppose that aimed society goal was to decrease commissions (especially consumption and trade) on drug abuse crime, we can see that according to the statistics spread of illicit drug use and trade with illicit drugs has not decreased. There is significant inconsistency between law and legal practice. The new legislation does not contribute to the adequate operating of legal system related to illicit drugs. Criminal law - by its characteristics - is not able to roll back drug consumption. On the base of our research we can say that modification had more negative than positive consequences. This statement is valid concerning procedures and impact on society as well.
